?We think Maine?s system is broken. It doesn?t avoid litigation, it doesn?t finalize claims within a reasonable time frame and it doesn?t enhance employers? competitiveness ? we believe it impedes all of those things,? said Bruce Gerrity, an attorney speaking for clients who self-insure for workers? comp. ?We want a system that works, we want a system that?s fair, we want a system that appropriately compensates injured employees, a system that allows us to prosper, grow, pay taxes, do things any business in Maine would want to do.?
The support and opposition broke down along employer-employee lines. Labor unions had organized a rally with injured workers earlier in the day, and many spoke at the hearing which started at 1 p.m. and ran into the evening Friday.
James Case, an attorney who represents employees in workers? comp cases and is a counsel to the Maine AFL-CIO, told lawmakers that this bill was about the firefighters, police officers, carpenters, health care workers and others who are working in Maine.
?Under this bill when those people reach a point in their disability of 11.8 years, this bill says goodbye, sayonara,? said Case. ?It doesn?t matter if due to psychiatric problems, physical problems or a combination. The end of the road comes at 11.8 years.?
He noted that in Maine, workers cannot sue their employers for injuries or deaths that occur while on the job, because the workers? comp system is the recourse for any such action.

Brian Demures talked about how he was paralyzed from the waist down due to a spinal cord injury he got in a construction accident that put him in the hospital for endless months.
?I still struggle with ongoing complications due to this catastrophic injury,? said Demures. ?If I thought I was going to lose my benefits after 11 years, my life would be more tragic than it is now.?
Jonathan Yellowbear of Litchfield said he had been an over-the-road trucker, but back injuries have put him out of the field.
?I?m staunchly against this bill, period,? Yellowbear said.
He said insurance companies fought covering his medical issues, until 2010 when he had major back surgery. But, he added, he?ll never drive a truck again.
?That was my livelihood,? he said.
Sherry Nadeau of Belgrade talked about her husband, who had been run over by his boss in a workplace accident. That was nine years ago, and he?s still in extreme pain, she said. They?ve been denied coverage by insurance companies and continue to have problems, she said.
?Why would you give more power to the insurance companies to abuse injured workers?? Nadeau said. ?This bill is continuing to erode what workers receive.?
Nadeau said she thought this bill would force more people onto welfare and increase the number of foreclosures, while ?insurance companies continue to make record profits.?
When Rep. Robert Hunt, D-Buxton, asked Sighinolfi about where injured workers would turn for help when they hit that cap of 618 weeks, he replied ?I don?t know.?
?We had this for years, and things seemed to work out ? people got on with their lives,? said Sighinolfi.
Sighinolfi said a cursory analysis by the national group that sets workers? comp rates suggested that his proposal may raise premiums slightly, or it could be revenue-neutral. He said the group didn?t look at other potential benefits, such as the possible decrease in litigation inherent in the system.
The current system, Sighnolfi said, is ?arbitrary, its unfair, it?s cumbersome.?
?It isn?t good for injured workers,? he said.
?This proposal,? he added, ?will bring certainty and clarity to the system.?
The proposal makes other changes. Currently, those collecting workers? comp get 80 percent of their weekly benefits, capped at $634, which is 90 percent of the statewide weekly average wage, post-tax. The proposal would increase the cap to 100 percent of the average wage, raising the weekly payout by $70.
Sighinolfi?s proposal would also reinstitute the automatic right of appeal in workers? comp cases. Now, they are appealed to the Maine Supreme Judicial Court, and the court can choose whether to hear them. They only choose to hear about 4 percent of the cases that are appealed, Sighinolfi said. Under the new system, a board made of hearing officers who were not on the case originally would review the appeal.

SALT LAKE CITY (AP) ? He’s eluded authorities for more than five years, a mountain man who roams the wilderness of southern Utah, breaking into remote cabins in winter, living in luxury off hot food, alcohol and coffee before stealing provisions and vanishing into the woods.
Investigators have clawed for clues, scouring cabins for fingerprints that match no one and chasing reports of brief encounters only to come up short, always a step behind the mysterious recluse.
They’ve found abandoned camps, dozens of guns, high-end outdoor gear stolen from the homes and trash strewn around the forest floor.
But the man authorities say is armed and dangerous and responsible for more than two dozen burglaries has continued to outrun the law across a swath of mountains not far from Zion National Park. He’s roamed across 1,000 square miles of rugged wilderness where snow can pile 10 feet deep in winter.
And while there have been no violent confrontations, detectives say he’s a time bomb. Lately he has been leaving the cabins in disarray and riddled with bullets after defacing religious icons, and a recent note left behind in one cabin warned, “Get off my mountain.”
“You wouldn’t want to come across that guy,” said Iron County Det. Jody Edwards, who has been working the case since 2007.
Theories about his identity have ranged from a 42-year-old man on the FBI’s Most Wanted List sought for the 2004 killing of an armored-truck guard in Phoenix to a castaway from the nearby compounds of the Fundamentalist Church of Jesus Christ of Latter Day Saints, the polygamous sect run by jailed leader Warren Jeffs.
The FBI recently discounted the theory that the man was their fugitive after authorities got the first pictures of him from a motion-triggered surveillance camera outside a cabin showing a sandy-haired man in camouflage on snowshoes, a rifle slung over his shoulder. The photos were captured sometime in December.
“We believe that is not Jason Derek Brown,” FBI special agent Manuel Johnson told The Associated Press.
However, Edwards isn’t so quick to rule out the possibility, given the close resemblance to Brown, who was raised Mormon and is a highly educated, well-traveled avid outdoorsman.
So while detectives believe they are getting close, buoyed by the recent photos, the shadowy survivalist remains an enigma. No missing person report appears to fit, and fingerprints lifted from cabins have yielded no match.
Meanwhile, cabin owners are growing more frightened by the day and are left wondering who might be sleeping in their beds this winter.
“He’s scaring the daylights out of cabin owners. Now everyone’s packing guns,” said Jud Hendrickson, a 62-year-old mortgage advisor from nearby St. George who keeps a trailer in the area.
In November 2010, Bruce Stucki, another cabin owner, said a burglar broke into his cabin through a narrow window, pried open a gun case with a crowbar and laid out the weapons but took none. At a nearby cabin, the man reportedly took only the grips from gun handles.
“He could stand in the trees and pop you off and no one would know who killed you,” Stucki said.
Some cabins he has left tidy and clean, while others he has practically destroyed, even defecating in one in a pan on the floor.
“He should know he’s being followed, but I don’t think this guy is normal in any way,” said Stucki, who, like many cabin owners, has a lot of his own theories.
“He’s anti-religious, waiting for the mothership to come in,” Stucki speculated.
Investigators say they have found several of the man’s unattended summer camps, what they initially thought were left behind by “doomsday” believers preparing for some sort of apocalypse because of the remote locations and supplies like weapons, radios, batteries, dehydrated food and camping gear.
Edwards said two camps found a few years ago were stocked with 19 guns. One of the camps also had a copy of Jon Krakauer’s “Into the Wild,” a book about a young man who died after wandering into the Alaskan wilderness to live alone off the land.
The cabin burglar has managed to avoid being seen all but twice over the years, each time retreating into the forest.
The coffee and alcohol the survivalist favors plays into some cabin owners’ assessment that he could be a castaway from the nearby twin towns of Hildale or Colorado City on the Utah-Arizona border. The so-called lost boys are said to be regularly booted from the polygamous sect there by elders looking to increase their marriage opportunities with young women.
Unlike members of The Church of Jesus Christ of Latter-day Saints, which discourages consumption of alcohol and coffee, many of the Mormon fundamentalists imbibe.
Detectives aren’t sharing their latest assessments but “we’ve got a lot of leads” from the surveillance photos, Edwards said. “I would say we’re very close to making a positive ID on him. We just got to catch this guy.”
To cabin owners in southern Utah, he remains a spooky and menacing figure.
“We feel like we’re being subject to terrorism by this guy,” Hendrickson said. “My wife says flat-out she’s not going back to our trailer until they catch him.”

The Internal Revenue Service is grappling with a?surge in identity theft-based tax fraud as crooks take advantage of web-based resources including electronic filing.
Identity theft cases, in which criminals obtain living or deceased people?s names and Social Security numbers to defraud the government, ranked No. 1 on an annual ?Dirty Dozen? list of tax scams the agency released Thursday. The IRS called ID theft one of the most complex threats it handles.
The IRS estimates 404,000 people were victimized by identity theft tax fraud from mid-2009 to the end of 2011.?
?We are seeing growth in this area. There?s no way around it,? said Terry Lemons, IRS director of communications. ?But I also think that we?ve gotten better at detecting it.?
The IRS said it stopped nearly 262,000 fake returns based on identity theft from being processed in 2011, preventing nearly $1.5 billion in refunds from going to criminals. That is more than a fivefold increase from 2010, when the agency stopped about 49,000 fake returns seeking $247 million in fraudulent refunds.
The IRS said it has no way of knowing how much in fraudulent refunds made it through the system undetected.
Experts say this type of fraud has increased thanks in part to the Internet. The Web has made it easier for honest people to file their tax returns — and for crooks to file fake returns electronically. The IRS has been on a major push to encourage people to file electronically.
?That was probably one of the biggest boons for the bad guys,? said Jay Foley, a partner with ID Theft Info Source and an identity theft expert.
With more than 100 million income tax refunds to process each year, the IRS concedes it will never be able to quell such tax fraud completely.
?The IRS cannot stop all identity theft. However, we are committed to continuing to improve our programs,? Steven T. Miller, the deputy commissioner for services and enforcement at the IRS, said in written congressional testimony in November.
The agency has added new filters to screen for potential identity theft tax fraud and is working harder to help victims get their rightful refunds.
In late January, the IRS and Justice Department announced a nationwide sweep of arrests, indictments and other actions against 105 suspected perpetrators of the crime in 23 states.
In its testimony to Congress, the IRS said it had initiated 276 investigations into identify theft tax fraud in fiscal 2011, up from 224 the previous year.
The IRS is under tremendous pressure to get taxpayers their refunds as quickly as possible while also accurately screening for fakes. That?s complex because people’s lives are complicated. Many of the things that might flag a return as fraudulent — such as a change in job, mailing address or name — are legitimate.
The new IRS filters mean that more people?s tax refunds will get extra screening before they go out, Lemons said.
?I think for the vast majority of taxpayers, they?re not going to see any difference,? he said. ?There will be some people who end up having some delays.?

Despite the agency’s efforts, Foley, the identity theft expert, expects the problem to get worse before it gets better. That?s because criminals keep finding new ways to evade IRS systems.
Still, he thinks the IRS is doing the best it can given its limitations. People want their legitimate tax refunds as fast as possible, but if the IRS doesn?t catch the fraud before the refund goes out, the agency may not even realize fraud has occurred until long after, when the real taxpayer goes to file a return.
?You can?t fix something until you know something is broke,? he said.
The crime appears to have surged in popularity rapidly.
In Florida, NBC television affiliate WFLA and The Tampa Tribune reported identity theft tax fraud had became so widespread that some people were offering classes in how to commit the crime.
The station’s investigation said the criminals dubbed the process ?TurboTax? after the popular online software for filing returns.
Julie Miller, a spokeswoman for TurboTax?s parent company, Intuit, said in an email that the company had amped up its own fraud prevention efforts over the past year. She declined to give details for fear of tipping off criminals.
In many cases, the fraud begins when a criminal steals someone’s name and Social Security number, and then uses them as a basis to create fake a return that ensures a hefty refund. The refund is sent to an address specified by the fraudster.
Another method involves getting the names, addresses and Social Security numbers of recently deceased people from websites such as Ancestry.com, which are meant to help people find their long-lost relatives.
